Terms of Service

1. Acceptance of Terms

  1. 1.1By downloading, installing, or using Free Roam ("the App", "the Game", "the Service"), you agree to be bound by these Terms of Service.
  2. 1.2If you do not agree, do not use the Service.
  3. 1.3We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of modified Terms.

2. Eligibility

  1. 2.1You must be at least 18 years of age to create an account and use the Service.
  2. 2.2You must be at least 21 years of age to access the Casino feature where available.
  3. 2.3You represent that all information provided during registration is accurate and truthful.
  4. 2.4One account per person. Multiple accounts are prohibited and will result in permanent suspension of all associated accounts.

3. Entertainment Purposes

  1. 3.1Free Roam is a video game intended solely for entertainment purposes.
  2. 3.2All in-game currencies (Cash, Premium Tokens, Crypto, Gold Coins, Sweepstakes Coins) are virtual items with no inherent monetary value except as explicitly described in the Premium Token Cashout Program and Casino Redemption Program.
  3. 3.3In-game activities including but not limited to buying, selling, trading, growing, manufacturing, and distributing virtual goods are fictional gameplay mechanics and do not represent, encourage, or endorse any real-world illegal activity.
  4. 3.4The Game does not promote, glorify, or encourage drug manufacturing, drug distribution, violence, theft, money laundering, or any illegal activity. All such elements are fictional gameplay mechanics within an entertainment product.

4. Account and Security

  1. 4.1You are responsible for maintaining the confidentiality of your account credentials.
  2. 4.2You are responsible for all activity that occurs under your account.
  3. 4.3You must notify us immediately of any unauthorized use of your account.
  4. 4.4We reserve the right to suspend or terminate any account at our sole discretion for any violation of these Terms.

5. In-App Purchases

  1. 5.1The App offers in-app purchases of virtual currencies (Cash packs, Premium Token packs) and virtual goods (Perks, cosmetic items).
  2. 5.2All purchases are processed through Apple App Store or Google Play Store and are subject to their respective terms.
  3. 5.3All purchases are final. No refunds will be issued except as required by applicable law or the policies of Apple or Google.
  4. 5.4Virtual currencies and goods have no real-world value and cannot be exchanged for real currency except through the Premium Token Cashout Program as described in Section 7.

6. Virtual Economy

  1. 6.1All in-game prices, conversion rates, fees, and economic parameters are set by the platform and may be adjusted at any time without prior notice.
  2. 6.2The platform charges a wire transfer fee (currently 3%) on all player-to-player currency transfers.
  3. 6.3The platform charges a marketplace fee (currently 5%) on all player-to-player item sales.
  4. 6.4The platform charges a conversion fee (currently 5%) on all currency conversions.
  5. 6.5All fees are subject to change at the platform's discretion.
  6. 6.6We reserve the right to modify, suspend, or discontinue any aspect of the virtual economy at any time.

7. Premium Token Cashout Program

  1. 7.1Premium Tokens (PT) may be redeemed for real-world currency or cryptocurrency through the Premium Token Cashout Program when available.
  2. 7.2The Cashout Program is not guaranteed to be available at all times and may be modified, suspended, or discontinued at any time at the platform's sole discretion.
  3. 7.3Cashout requires completion of KYC (Know Your Customer) verification including government-issued photo ID, legal name, address, and date of birth.
  4. 7.4Participants must be 18 years of age or older.
  5. 7.5The platform retains 50% of the base value of all PT redeemed, plus a 2.5% payment processing fee.
  6. 7.6Monthly cashout caps apply and are set at the platform's discretion. Caps may change without prior notice.
  7. 7.7Payouts are processed monthly. The platform is not responsible for delays caused by payment processors.
  8. 7.8The platform reserves the right to deny, delay, or reverse any cashout if fraud, abuse, or Terms violations are suspected.
  9. 7.9PT has no guaranteed cash value until a cashout request is approved and processed. Accumulating PT does not create an obligation for the platform to pay any specific amount.
  10. 7.10Tax reporting: Players are solely responsible for reporting and paying any taxes on cashout earnings. The platform will issue IRS Form 1099 to US-based players receiving $600 or more in cashout payouts per calendar year.

8. Casino and Sweepstakes (when applicable)

  1. 8.1The Casino feature operates under sweepstakes law and is completely separate from the main game economy.
  2. 8.2Gold Coins (GC) are purchased for entertainment and have no cash value.
  3. 8.3Sweepstakes Coins (SC) are provided as a free promotional bonus and are never directly purchased.
  4. 8.4SC may be redeemed for real money or cryptocurrency as sweepstakes prizes.
  5. 8.5No purchase is necessary to obtain SC or participate in sweepstakes games.
  6. 8.6The Casino feature is not available in all states. Users in restricted states will not have access to the Casino.
  7. 8.7Users must be 21 years of age or older and complete Casino-specific KYC verification to access the Casino.
  8. 8.8The platform reserves the right to modify, suspend, or discontinue the Casino at any time.
  9. 8.9Casino game outcomes are determined by a certified Random Number Generator (RNG).
  10. 8.10Responsible gaming tools (self-exclusion, session limits, loss limits, deposit limits) are available within the Casino.

9. Prohibited Conduct

  1. 9.1You may not use bots, scripts, macros, or automated tools to interact with the Service.
  2. 9.2You may not create or operate multiple accounts.
  3. 9.3You may not exploit bugs, glitches, or unintended game mechanics for personal gain.
  4. 9.4You may not engage in real-money trading of in-game items, currencies, or accounts outside of the platform's official systems.
  5. 9.5You may not harass, threaten, or abuse other players.
  6. 9.6You may not upload, share, or distribute offensive, illegal, or inappropriate content through user-generated content features.
  7. 9.7You may not attempt to hack, reverse-engineer, or compromise the security of the Service.
  8. 9.8Violation of any prohibited conduct may result in immediate account suspension or permanent ban, forfeiture of all virtual currencies and items, and forfeiture of any pending cashout balance.

10. Intellectual Property

  1. 10.1All content, design, code, trademarks, and intellectual property within Free Roam are owned by the platform.
  2. 10.2Players retain no ownership rights to virtual items, currencies, characters, or any in-game content.
  3. 10.3User-generated content (custom skins, uploaded images) grants the platform a worldwide, royalty-free, perpetual license to use, display, and distribute that content within the Service.

11. Disclaimer of Warranties

  1. 11.1The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
  2. 11.2We do not guarantee uninterrupted, error-free, or secure operation of the Service.
  3. 11.3We do not guarantee any specific level of earnings from the Cashout Program or Casino.
  4. 11.4We do not guarantee the availability of any feature at any time.

12. Limitation of Liability

  1. 12.1To the maximum extent permitted by law, the platform and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  2. 12.2Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

13. Dispute Resolution and Arbitration

  1. 13.1All disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  2. 13.2You waive your right to participate in class action lawsuits or class-wide arbitration.
  3. 13.3Arbitration shall take place in the state of [state of incorporation].

14. Termination

  1. 14.1We may terminate or suspend your account at any time, with or without cause, with or without notice.
  2. 14.2Upon termination, all rights granted to you cease immediately.
  3. 14.3Virtual currencies, items, and progress are forfeited upon termination for cause (Terms violation).
  4. 14.4Any pending cashout balances may be forfeited upon termination for cause.

15. Governing Law
